Terms of Service

By using the Kidivity mobile application, you agree to the following terms and conditions. Please read them carefully.

1. Acceptance of Terms

Kidivity ("we", "us", or "our") provides its service to you subject to these Terms of Service. By accessing or using our application, you acknowledge that you have read, understood, and agree to be bound by these terms. You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account and use this service. Kidivity is intended to be operated by parents or legal guardians on behalf of their children.

2. Description of Service

Kidivity is a mobile application that uses Artificial Intelligence to generate customizable educational and creative activities for children. The app offers both a free tier with limited access and premium subscription plans for enhanced usage.

3. Free Tier

Kidivity provides a free tier that allows users to generate activities at a limited rate. Free users may generate 1 activity every 48 hours. The free tier is subject to change at our discretion and may be modified or removed with reasonable notice.

4. Subscriptions and Payments

Kidivity offers premium subscription plans that unlock higher activity generation limits:

• Monthly Pro: Up to 100 activity generations per 30-day period. Billed monthly on a recurring basis.
• Annual Pro: Up to 10 activity generations per 24-hour period. Billed annually on a recurring basis.
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Payments: All payments are processed exclusively through your Apple App Store or Google Play Store account. We do not directly collect or store any payment card or banking information.
• Subscription Management: You can view, manage, or cancel your subscription at any time through the in-app Subscription Management center (powered by RevenueCat) or through your device's native account settings (Apple ID or Google Play).
• Restore Purchases: If you reinstall the app or switch devices, you can restore your active subscription from the Settings screen within the app.
• Cancellation Effect: If you cancel your subscription, you will retain access to your Pro benefits until the end of your current paid billing period. After expiration, your account will revert to the free tier limits.
• Refunds: All subscription purchases are processed and managed by the Apple App Store or Google Play Store. Refund requests must be directed to Apple or Google through their respective refund processes. We do not have the ability to issue refunds directly.

5. Generation Quotas and Limits

Activity generation is governed by a quota system tied to your subscription tier. Generation limits reset on a rolling-window basis (not on a fixed calendar date). Quotas are non-transferable between accounts and have no monetary value. We reserve the right to adjust quota limits, reset windows, or tier structures to ensure fair usage and service sustainability.

6. Use of AI-Generated Content

The activities provided by Kidivity are generated by AI. While we strive for accuracy and age-appropriateness, we encourage parents and guardians to review all generated content before providing it to their children. We are not liable for any inaccuracies, omissions, or inappropriateness in the generated material.

7. Content Ownership

We grant you a personal, non-exclusive, non-transferable license to use, download, and print the activities generated through the app for personal, non-commercial educational use only. You may not resell, redistribute, or commercially exploit any generated content.

8. Account Termination

We reserve the right to terminate or suspend your account and access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service. Termination does not entitle you to a refund of any subscription fees already paid.

9. Limitation of Liability

Kidivity is provided "as is" without any warranties. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the app.

10. Changes to Terms

We may update these Terms from time to time. Any changes will be reflected by updating the "Last updated" date at the bottom of this page. We may also notify you of material changes through an in-app notice. Your continued use of the service after any such changes constitutes your acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the service shall be resolved in accordance with the dispute resolution mechanisms provided by the Apple App Store or Google Play Store, as applicable.
